D&B Two Ways to Win Sweepstakes
OFFICIAL RULES
- HOW TO ENTER: No purchase necessary. All eligible persons who go to dnbexpress.ca and purchase a credit report from The D&B Companies of Canada Ltd. (“D&B”) during the Contest Period (as hereinafter defined) will have their name automatically entered by D&B into the D&B Two Ways to Win Sweepstakes (“Contest”). Contestants will receive one entry into the weekly prize draw for every credit report purchased online as defined below and one entry for the Grand Prize draw. Alternatively, please send your name, business address and business phone number on a postcard to Attention: D&B Two Ways to Win Sweepstakes, P.O. Box 6200 Station A, Mississauga ON L5A 4G4 to be entered into the Contest.
- CONTEST PERIOD: To enter the Contest, you must purchase a credit report with your credit card at dnbexpress.ca during the period between 12:01 a.m. on September 18, 2006 and 11:59 p.m. (EST) on November 5, 2006 (“Contest Period”).
- THE PRIZES: There are eight (8) prizes (“Prizes”) available to be won by way of the Random Draw. Approximate retail value of all prizes is $2900.00 (CAD). There is one (1) Grand Prize of a Dell Inspiron 6400 Laptop Computer. Approximate retail value of the Grand Prize is $1500.00 (CAD).
There will be seven (7) weekly draws for a $200 American Express® Gift Cheque. Each secondary prize is one (1) $200.00 (CAD) American Express® Gift Cheque. American Express® Gift Cheques can be redeemed anywhere the American Express Card is accepted. The weekly draws will take place as follows:
Week 1 Draw: All credit reports purchased between 12:01 a.m. on September 18, 2006 to 11:59 p.m. (EST) on September 24, 2006 will receive one (1) entry into the Sweepstakes to win a $200 American Express® Gift Cheque.
Week 2 Draw: All credit reports purchased between 12:00 a.m. on September 25, 2006 to 11:59 p.m. (EST) on October 1, 2006 will receive one (1) entry into the Sweepstakes to win a $200 American Express® Gift Cheque.
Week 3 Draw: All credit reports purchased between 12:00 a.m. on October 2, 2006 to 11:59 p.m. (EST) on October 8, 2006 will receive one (1) entry into the Sweepstakes to win a $200 American Express® Gift Cheque.
Week 4 Draw: All credit reports purchased between 12:00 a.m. on October 9, 2006 to 11:59 p.m. (EST) on October 15, 2006 will receive one (1) entry into the Sweepstakes to win a $200 American Express® Gift Cheque.
Week 5 Draw: All credit reports purchased between 12:00 a.m. on October 16, 2006 to 11:59 p.m. (EST) on October 22, 2006 will receive one (1) entry into the Sweepstakes to win a $200 American Express® Gift Cheque.
Week 6 Draw: All credit reports purchased between 12:00 a.m. on October 23, 2006 to 11:59 p.m. (EST) on October 29, 2006 will receive one (1) entry into the Sweepstakes to win a $200 American Express® Gift Cheque.
Week 7 Draw: All credit reports purchased between 12:00 a.m. on October 30, 2006 to 11:59 p.m. (EST) on November 5, 2006 will receive one (1) entry into the Sweepstakes to win a $200 American Express® Gift Cheque.
- CONTEST DRAW: Weekly winners will be selected from among all eligible entries as noted above as follows:
Week 1 Draw: September 26, 2006 in Toronto, Ontario at 2 p.m. EST.
Week 2 Draw: October 3, 2006 in Toronto, Ontario at 2 p.m. EST.
Week 3 Draw: October 10, 2006 in Toronto, Ontario at 2 p.m. EST.
Week 4 Draw: October 17, 2006 in Toronto, Ontario at 2 p.m. EST.
Week 5 Draw: October 24, 2006 in Toronto, Ontario at 2 p.m. EST.
Week 6 Draw: October 31, 2006 in Toronto, Ontario at 2 p.m. EST.
Week 7 Draw: November 7, 2006 in Toronto, Ontario at 2 p.m. EST.
The Grand Prize winner will be selected from among all eligible entries as noted above on November 7, 2006 in Toronto, Ontario at 2 p.m. EST.
The selected entrants will be notified by email or telephone. To be declared a winner, a selected entrant must, within fourteen (14) days following attempted notification: (1) correctly answer a time limited mathematical skill testing question (without human, mechanical, electronic or other assistance) to be administered by telephone; and (2) sign a declaration, release and indemnity form, satisfactory to D&B, confirming compliance with the Contest rules, releasing D&B, its subsidiaries, affiliated and related companies, its promotional and advertising agencies (including, without limitation, Emerson Group), and their officers, directors, shareholders, employees, agents, consultants and representatives, subsidiaries, related and affiliated companies, from any and all liability arising from or related to the Contest and indemnifying D&B and the aforesaid persons in respect of any claims made arising from the selected entrant’s participation in the Contest and/or his/her receipt of the Prize. If the selected entrant fails to comply with the aforesaid conditions within the aforesaid 14 day period, he/she may be disqualified and the Prize may be awarded to another entrant. No substitution for, or transfer of, the Prize by the selected entrant will be allowed.
- ELIGIBILITY: The Contest is only open to individuals who go online to dnbexpress.ca and purchase a Credit Report using their credit card, who are Canadian residents and who have reached the age of majority in their province of residence at the time of entering the Contest. Employees, directors, officers, shareholders, consultants, agents and representatives of D&B, its subsidiaries, affiliated and related companies, D&B’s advertising agency (including, without limitation, Emerson Group) and their affiliates as well as their immediate family (defined as parents, children, siblings and spouse) or persons living in the same household are not eligible to enter this Contest. Customers receiving an online discount on Credit Reports through a partnership with D&B are not eligible to enter this Contest (with the exception of customers participating in Express Club). Odds of winning depend upon the total number of persons who purchase a Credit Report online at dnbexpress.ca during the Contest Period.
- SUBSTITUTION OF PRIZE: The Prize shall be accepted as awarded and may not be exchanged by the selected entrant for any amount of money. The Prize may not be substituted nor transferred by the selected entrant. If requested by D&B, the selected entrant must produce valid identification at the time that he/she is awarded the Prize. D&B reserves the right to substitute the Prize or any Prize component with another of comparable or greater value. If the selected entrant refuses to accept the Prize as awarded, D&B, its advertising or promotional agencies, their subsidiaries, affiliates and related companies as well as their respective directors, officers, shareholders, employees, consultants, agents and representatives shall be automatically released of any and all obligations to the selected entrant. D&B or its advertising agency shall arrange for the Prize to be delivered to the selected entrant at his/her residence in Canada.
- GENERAL TERMS AND CONDITIONS: D&B, its respective advertising or promotional agencies, and their subsidiaries, affiliated and related companies, and their officers, directors, shareholders, employees, consultants, agents and representatives shall not be liable for any loss or damage caused directly or indirectly by technical difficulties or errors in the administration of the Contest or acts of God or any other matter outside of D&B’s control which may affect the conduct of the Contest.
D&B assumes no responsibility for lost, delayed, destroyed, misidentified or misdirected entries. In addition, D&B assumes no responsibility for incorrect or inaccurate capture of entry information, technical malfunctions, human or technical errors, printing errors, lost, delayed, stolen, destroyed, altered or garbled data or transmissions, errors, omissions, interruptions, deletions, defects or failures of any telephone or computer line or network, computer equipment, software, email, computer online systems or servers, players, browsers, traffic congestion on the internet or at any web site or any combination thereof, whether originating from sender or recipient. Entry materials/data that have been tampered with or altered are void.
Only a person declared by D&B to be the selected entrant will be entitled to the Prize, subject to the selected entrant’s eligibility for this Contest and his/her compliance with these Contest rules.
By participating in this Contest, participants agree to be bound by these rules. In the event of any disagreement as to whether a person is eligible as a contestant, or as to the qualifications of the selected entrant, the decision of D&B shall be final. All decisions with respect to all matters relating to the Contest shall be made by D&B and any such decisions shall be final and binding in all respects and there shall be no rights of appeal with respect to any such decision. Participants may be disqualified if they do not comply with the Contest rules.
Subject to the jurisdiction of the Régie des alcohols, des courses et des jeux (the “Régie”) in Quebec, D&B reserves the right to terminate the Contest or to modify the Contest rules as necessary for any reason, without notice, including, without limitation, in order to comply with any applicable law or policy or in the event that the Contest is not capable of being conducted as originally planned, or if fraud or any other occurrence compromises the fairness or integrity of the Contest. If for any reason the Contest is not capable of being completed as planned including, but not limited to computer virus, tampering, technical failures or other causes beyond the control of D&B, D&B reserves the right to cancel, suspend or modify the Contest.
Any attempt by a participant, to deliberately damage any web site or undermine the legitimate operation of this Contest, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Should such an attempt be made, D&B reserves the right to seek remedies and damages from any such individual or person, to the fullest extent permitted by law, including criminal prosecution. A participant engaging in any of the foregoing activities may be disqualified and will forfeit any Prizes awarded.
This Contest is subject to all applicable federal, provincial and municipal laws. The Contest is void in every jurisdiction where it is prohibited or restricted by any law, statute or other appropriate authority. D&B does not warrant that this Contest may be entered into legally in any particular jurisdiction.
All entries and submitted material will become the property of D&B and none will be acknowledged or returned. Taxes and any other expenses, if any, are the sole responsibility of the selected entrant.
D&B shall not be held responsible for any problems, errors or negligence that may arise or occur in connection with the Contest, including but not limited to any damage to a participant’s computer equipment, computer system, software or any combination thereof, as a result of the participant’s participation in this Contest. Each entrant hereby acknowledges and agrees that D&B shall not be responsible for nor bear any liability for the loss, theft or misuse of the Prize. Each entrant further acknowledges and agrees that D&B shall not be responsible for nor bear any liability for any property damage, personal injury or misfortune in any way attributable to this Contest, the Prize or the entrant’s participation in this Contest.
By entering this contest, participants consent to the collection and use of their personal information (information that identifies them as an individual, for example, home telephone number, age and home address, etc.) collected during the purchase of a credit report by D&B for the following purposes and uses:
1. to administer the Contest;
2. to extend promotional offers, literature and materials to the participant regarding D&B, its subsidiaries, related and affiliated companies, and their products and/or services;
3. to analyze sales information and data;
Participants consent to the use of their names and likeness for advertising and publicity purposes by D&B and its affiliated and related companies, without additional compensation, unless prohibited by law.
No correspondence or notice with respect to this Contest will be provided to entrants except the selected entrants who will be contacted by email or phone.
For contestants who are residents of Quebec, any litigation respecting the conduct or organization of the Contest may be submitted to the Régie for a ruling. For contestants who are residents of Quebec, any litigation respecting the awarding of a Prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement
To receive a list of the winners, send a self-addressed, stamped prepaid envelope to D&B c/o Emerson Group, 577 Wellington Street West, Toronto, Ontario M5V 1G3.
